1. Purpose and acceptance
These Terms of Service (the "Terms") set out the terms and conditions governing the use of the services offered by Jérémy Aurélien BODIN, sole trader trading as ARLOAD (SIREN 944 753 979, 41 rue Coëtquen, 22100 Dinan, France) ("Evora", "we") through its mobile app and its website at evora.live (the "Service").
Accepting the Terms is mandatory when signing up. By ticking the "I accept the Terms of Service and the Privacy Policy" box when creating your account, you acknowledge that you have read, understood and accepted these Terms without reservation.
If you do not accept all or part of these Terms, you must not create an account or use the Service.
2. Description of the service
Evora is a platform that connects:
- Users ("members") who want to discover and attend local events (concerts, parties, exhibitions, workshops, sport, etc.);
- Organizers (associations, companies, individuals, public bodies) who publish and manage those events.
Evora offers, among others, the following features:
- Discovery of nearby events with a map and filters
- Free or paid registration for events run by third parties
- Following organizers and push notifications
- Real-time location sharing with friends
- Personalised year-in-review recap
- Dedicated organizer tools (announcements, Q&A, statistics, promo codes, Stripe billing)
Evora acts solely as a technical platform and does not organise events itself. Organizers are solely responsible for the content, the running and the reception of attendees at their events.
3. User account
3.1 Eligibility
The Service is open to any natural person:
- Aged 15 or over (Article 7.1 GDPR — French threshold). Minors between 15 and 18 must obtain their legal guardian's permission to register for paid events;
- Having full legal capacity or, where applicable, the consent of their legal guardian;
- Aged at least 18 to create or own an organization, or to hold a post that gives access to its money (billing, revenue, payouts), and at least 16 to join an organization's team as a member or volunteer;
- Whose Evora account has not previously been permanently suspended.
3.2 Creating an account
Users sign up by providing a valid email address, a password of at least 8 characters, their first name, last name and date of birth. They may alternatively sign up through the Google, Apple or Facebook OAuth providers.
Users undertake to provide accurate, complete and up-to-date information. Any false declaration may lead to the immediate suspension of the account without notice.
3.3 Account security
Users are solely responsible for keeping their login credentials confidential. Any action taken from their account is deemed to be taken by them. If unauthorised access is suspected, users undertake to change their password immediately and to contact support at [email protected].
Evora recommends enabling two-factor authentication (2FA via TOTP), available under Settings > Security.
3.4 One account per person
Each user may hold only one Evora account. Creating multiple accounts for fraudulent purposes (evading a suspension, promotion fraud, fake engagement) will result in the immediate suspension of every account involved.
4. Expected conduct
Users undertake to use the Service fairly, for its intended purpose and in accordance with applicable laws and regulations. The following are in particular prohibited:
- Posting unlawful content (glorification of crimes against humanity, incitement to discrimination, hatred or violence, child sexual abuse material, etc.);
- Harassment, intimidation, doxxing (disclosing someone else's personal information without their consent);
- Spam, unsolicited commercial messages, mass soliciting of organizers;
- Spreading false information about an event or an organizer (false reports, fake reviews);
- Impersonation (passing yourself off as another person, an organizer, a brand or an authority);
- Mass collection or extraction of data by automated means (scraping, scripts, bots);
- Any attempt to disrupt the Service (denial-of-service attacks, exploiting vulnerabilities, circumventing security measures);
- Unauthorised resale of event tickets (fraudulent secondary ticketing);
- Posting copyright-protected content without the rights holder's permission.
Any breach of these rules may result in the removal of the content, a warning, or a temporary or permanent suspension of the account, without notice or compensation, and without prejudice to any legal proceedings.
5. Intellectual property
5.1 Evora's property
All elements making up the Service (the Evora trademark, logo, visual identity, source code, design, interface, database, documentation) are protected by intellectual property law and remain the exclusive property of Jérémy BODIN (ARLOAD) or his rights holders.
Any unauthorised reproduction, display, modification, adaptation or extraction of these elements is strictly prohibited and may give rise to civil and criminal proceedings.
5.2 Content posted by users
Users retain full intellectual property ownership of the content they post on Evora (photos, text, questions, announcements, etc.).
By posting content on Evora, users grant Evora a non-exclusive, worldwide, royalty-free licence for the full term of copyright allowing Evora to reproduce, host, display, adapt and modify that content for the sole purpose of displaying it within the Service and promoting the Service (for example through event thumbnails).
Users warrant that they hold the necessary rights over the content they post and that it does not infringe third-party rights (image rights, copyright, trademarks, etc.). Users indemnify Evora against any claim in this respect.
6. Moderation and reporting
In accordance with Regulation (EU) 2022/2065 on digital services (DSA), Evora provides its users with a mechanism to report content that is unlawful or contrary to these Terms:
- A "Report" button on every event, organizer profile and post;
- A dedicated email address: [email protected].
Evora undertakes to review reports within a reasonable time and to take appropriate action (warning, content removal, account suspension, referral to the authorities where applicable).
Abusive or mass reports made in bad faith may lead to sanctions against their author.
7. Suspension and termination
7.1 Suspension by Evora
Evora reserves the right to suspend or terminate a user's account, without notice or compensation, in the following cases:
- Breach of these Terms or of the law;
- Compromising the security of the Service or of other users;
- Fraudulent behaviour (false identity, payment fraud, etc.);
- Non-payment of amounts due (for paying organizers).
Termination results in the deletion of the account and the inability to sign up again. Data is anonymised as described in the Privacy Policy.
7.2 Termination by the user
Users may terminate their account at any time and without giving a reason from My data > "Delete my account". A 30-day grace period applies, during which users can cancel their request by logging back in. After that period, the data is irreversibly anonymised.
8. Limitation of liability
Evora strives to provide a reliable, secure Service available 24/7, but cannot guarantee the complete absence of errors, interruptions or bugs. The Service is provided "as is" and "as available".
Evora does not organise the events listed on the platform and cannot be held liable for:
- How the events actually unfold;
- The content published by organizers;
- The direct contractual relationship between attendees and organizers (payment, reception, cancellation by the organizer, etc.);
- Indirect damages (loss of opportunity, loss of enjoyment, moral prejudice) arising from the use of the Service.
Evora's total liability towards a user, on any ground whatsoever, is limited to the amounts actually paid by that user to Evora during the twelve (12) months preceding the event giving rise to the damage. For users who have paid nothing, this cap is 100 euros.
9. Governing law and jurisdiction
These Terms are governed by French law.
In the event of a dispute, the parties will endeavour to reach an amicable settlement before any legal action. Failing that, the dispute will be brought before the competent courts of Paris, notwithstanding multiple defendants or third-party proceedings.
In accordance with Article L612-1 of the French Consumer Code, consumers may use a consumer mediation service free of charge. Evora is a member of the FEVAD e-commerce mediation scheme (French federation of e-commerce and distance selling): https://www.mediateurfevad.fr.
10. Changes to the Terms
Evora reserves the right to amend these Terms at any time. In the event of a material change, users will be informed by email and by an in-app notification at least 30 days before the new Terms take effect.
Continuing to use the Service after the new Terms take effect constitutes acceptance. If users do not accept them, they may terminate their account free of charge before the effective date.
